These Terms of Use (“Terms”) govern your access to and use of Wine Identifier App (“Service”), including the website at wineidentifier.app and any related mobile application operated by or on behalf of the Service. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Wine Identifier App is a wine identifier app that scans wine labels, identifies bottles, suggests pairings, and helps wine drinkers track their cellar.

Wine Identifier App is an independent wine information and cellar-tracking tool. It is not affiliated with any winery, distributor, retailer, restaurant, critic publication, or third-party wine database unless a formal partnership is disclosed separately on the Service.

Eligibility and Age Requirements

The Service is intended for adults of legal drinking age in their jurisdiction. You may not use the Service if you are under the minimum legal age to purchase or consume alcohol where you live. By using the Service, you represent that you meet applicable age requirements and that providing wine-related information to you is lawful in your location.

We do not knowingly collect personal information from individuals below the legal drinking age. If you believe a minor has created an account or submitted data through the Service, contact us through the support channel listed on https://wineidentifier.app/brand-facts so we can review and remove the account where appropriate.

Not Professional, Medical, or Investment Advice

Wine identification results, tasting notes, crowd ratings, price estimates, drinking-window suggestions, food-pairing recommendations, and cellar inventory features are provided for general informational and personal organization purposes only. They are not professional sommelier services, medical advice, addiction counseling, legal advice, or investment guidance.

Label scans and database matches can be incomplete or incorrect, especially for rare bottles, damaged labels, private imports, or newly released wines. Always verify producer, vintage, region, and condition before relying on a scan for purchase, resale, insurance, or consumption decisions. Price and value signals reflect available market or community data and may not match retail shelf prices, restaurant markups, auction results, or appraised value.

Acceptable Use

You agree to use the Service lawfully and responsibly. Without limiting other restrictions, you may not:

  • Use the Service to promote illegal alcohol sales, underage drinking, or unsafe consumption.
  • Upload content you do not have the right to share, including photos that violate privacy, copyright, or restaurant policies.
  • Attempt to reverse engineer, scrape, overload, disrupt, or circumvent security or access controls except as permitted by law.
  • Misrepresent scan results, ratings, or cellar records as certified appraisals, authenticity guarantees, or professional endorsements.
  • Use automated bots or bulk harvesting to extract database content without written permission.
  • Harass other users, post unlawful content, or interfere with normal operation of the Service.

Restaurant and retail environments may restrict phone photography. You are responsible for following house rules, local laws, and the instructions of staff when scanning labels or wine lists in public settings.

Accounts, Subscriptions, and App Store Terms

Certain features may require account registration or a paid subscription. You are responsible for maintaining the confidentiality of your login credentials and for activity that occurs under your account. Notify us promptly if you suspect unauthorized access.

If you download a mobile app through Apple App Store, Google Play, or another marketplace, purchases and refunds may also be subject to that platform’s terms and billing policies. Where app-store rules conflict with these Terms on payment matters, the platform terms may control for that transaction.

We may modify, suspend, or discontinue features, pricing, or availability with reasonable notice when practicable. Free tiers, trial periods, and promotional offers may change or end at any time.

User Content and License

You retain ownership of photos, notes, ratings, and other content you submit (“User Content”). By submitting User Content, you grant Wine Identifier App a non-exclusive, worldwide, royalty-free license to host, process, display, and use that content solely to operate, improve, and secure the Service, including training or tuning recognition models where disclosed in our https://wineidentifier.app/privacy-policy.

You represent that you have the rights needed to submit User Content and that doing so does not violate any law or third-party rights. We may remove content that appears unlawful, abusive, infringing, or inconsistent with these Terms.

Intellectual Property

The Service, including software, design, text, logos, and compiled wine data presented through the interface, is owned by Wine Identifier App or its licensors and is protected by applicable intellectual-property laws. Except for the limited right to use the Service as intended, no license is granted to copy, modify, distribute, or create derivative works without prior written consent.

Third-party trademarks, bottle images, critic scores, and database entries belong to their respective owners. Reference to external brands or services does not imply endorsement unless explicitly stated.

Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Wine Identifier App disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy of identification, uninterrupted availability, and non-infringement.

We do not guarantee that scans will identify every bottle, that pairings will suit every dish, that cellar counts will remain accurate without manual updates, or that any particular drinking window, score, or price estimate is current or complete.

Limitation of Liability

To the fullest extent permitted by law, Wine Identifier App and its officers, directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or cellar records, arising from or related to your use of the Service.

Our total liability for any claim arising out of these Terms or the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve months before the claim or (b) fifty U.S. dollars, except where applicable law requires otherwise.

Indemnity

You agree to defend, indemnify, and hold harmless Wine Identifier App from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, your User Content, your violation of these Terms, or your violation of any law or third-party right.

Termination

We may suspend or terminate access to the Service if we reasonably believe you violated these Terms, created security risk, or used the Service unlawfully. You may stop using the Service at any time. Sections that by nature should survive termination—including disclaimers, limitations of liability, indemnity, and governing law—will survive.
